I want to end a periodic tenancy straight away, can I do this?
hi, I currently have a periodic tenancy which starts from the 25th of every month, rent is currently paid up until 25/08/09. My landlord has failed to repair the following details, some of which i made him aware of more than 12 months ago.
Patio door, insecure and could easily be broken into (I am sure this invalidates my contents insurance.
handrail on stairs – health and safety
Drawer in kitchen completely broken
Not hot tap in bath (althougbh we have a shower)
Only one smoke alarm downstairs which currently doesn’t work, im sure need one on each floor.
I have a 19 month old daughter and have been offered a new home to occupy from this month.
Due to the failures on my LLDs side can i terminate without notice at the end of this periodic month?
I have always paid rent on time and feel let down.
Are there any housing acts i can quote to my LLD to confirm i can do this legally (if i can

If by periodic tenancy you mean rolling month to month, then you must give the LL one full month’s notice. “Rolling month to month lease” means that your original tenancy agreement time ran out. (usually 6 or 12 months, and then the contract wasn’t renewed? Is this the case for you?)
Unfortunately, on some of the repair failure points, there isn’t much you can do.
Okay, The patio door DOES need fixing legally or yes, your contents insurance ain’t worth the paper its written on. He should’ve sorted this asap.
There is no law saying that stairs have to have a handrail.
A Landlord doesn’t have to provide drawers at all in the kitchen (my kitchen has no drawers at all – and yeah, it sucks!!)
Contrary to popular belief, smoke alarms are NOT legally required to let a property unless it is a HMO – house of multiple occupation – meaning that it is divided into seperate units or flats. Most LL’s fit them for common sense. If their house burns down, they cant rent it out.
And lastly, as you have a form of hot water in the house (whether upstairs or down) the landlord is legal.
Stupid I know and as your LL obviously doesn’t give a cr** about his tenants, give your notice and get out.
Just bear in mind that bad landlords rarely willingly give deposits back without a fight so make sure you clean the house thoroughly (its about £20 a day to hire a carpet cleaning machine and would be well worth your while)
Also, if possible, put a lick of fresh paint on the walls if you can.
Take as many photos as humanly possible, and make sure you do a thorough walk through with the LL and get him to give you a copy of the inventory/inspection report.
Either that or you could not pay your last month’s rent and let him have the deposit but this is not legal and I don’t recommend it. He could haul you to court.
